This is the long-awaited book by the celebrated philosopher Antony Duff concerned with the 'general' principles of criminal responsibility and liability. The general part in this sense consists in those doctrines, rules and definitions that are not essentially tied to any specific offence or set of offences. The first aim of the book therefore is to explore a concept of criminal responsibility (which Duff terms 'answerability') which sees responsibility as a relational, practice-based, matter, which crucially preserves the distinction between responsibility and liability. The book also looks at those special conditions which determine when a criminal suspect may not be held answerable (legal or moral bars to trial). At all times the distinction between responsibility and liability is kept clear, helping to throw light on the important distinctions between criminal and moral liability, and leading naturally into an examination of how defences are to be distinguished from justifications and excuses. The net result is not a theory of criminal law; but it is an account of the structure of criminal law as an institution (or set of institutions) through which a liberal polity can define a realm of public wrongdoing, and call those who perpetrate (or are accused of perpetrating) such wrongs to account.
